Brian has served those clients by writing clear and easy to read documents; by seeking out unique and direct solutions to complex problems through mediation or creative problem-solving; and by tenaciously litigating those matters that could only be resolved through the courts. In all of these situations, Mr. Fellner has demonstrated the ability and the determination to obtain the very best result for the clients of FLS.  

Brian is an experienced lawyer and a talented litigator who provides legal services to condominiums, homeowners associations, and cooperatives throughout Maryland, Virginia, and the District of Columbia. He has represented clients in all facets of community association governance, management, and dispute resolution. From writing bylaws or rules to enforcing covenants and contracts to collecting delinquent assessments, Brian has worked tirelessly to provide excellent legal services to FLS clients and communities of all sorts. 

In addition to his law practice, Mr. Fellner regularly presents to management companies, boards, and community association industry members on topics including board of director governance, covenant enforcement, super-priority lien foreclosures, bankruptcy, and many other matters of interest to community associations. He has advocated on Capitol Hill and authored an amicus curae appellate brief on behalf of issues that affect condominiums, homeowners associations, cooperatives, and FLS clients.  

During his career, Brian has drafted numerous amendments and policies for clients. He has successfully obtained injunctions to terminate covenant violations, and then successfully defended those orders on appeal. On behalf of clients confronting urgent issues, Brian has obtained temporary restraining orders (“TROs”) to prevent irreparable harm. Brian has successfully represented clients in disputes with developers, neighboring property owners, and government entities. By providing well-reasoned and cutting-edge legal opinions, Brian has guided clients past the many pitfalls that can ensnare communities, including avoiding selective enforcement, discrimination, fair housing violations, and waiver of rights. In the collections arena, Mr. Fellner has collected thousands of dollars in delinquent assessments through his combination of sensible negotiation, no-nonsense litigation, and zeal to go the extra mile. His extensive knowledge of and experience with foreclosures, short sales, tax sales, and bankruptcies is a great asset to FLS clients who rely on the collection of their assessments to survive and thrive.

Beyond the community association world, Mr. Fellner has successfully litigated contract disputes, real estate transactions, negligence cases, motor torts, and DUI/criminal matters. He has written wills, obtained divorce decrees, and filed bankruptcies on behalf of consumers and businesses. The experience gained from each of these diverse cases helps Mr. Fellner provide client-driven legal services in a plain-spoken and easy to understand fashion. That background and reputation is what let him to found FLS and dedicate himself to living up to its motto:
