Board member training, education on legal topics of interest.
FLS prepares amendments to or new versions of the declaration, bylaws, policy resolutions, and rules and regulations of community associations.
By interpreting governing documents and advising boards of their rights, obligations, and legal issues, FLS assists communities in avoiding problems and increasing the quality of life in their association.
The statutes that govern community associations and the governing documents that create them both set out a framework for resolving disputes with owners and residents. FLS is skilled in navigating these disputes, obtaining the desired results, and litigating the cases that cannot be resolved any other way.
Developers who create communities often fail to live up to their obligations to the purchasing owners; FLS puts our experience in these disputes to work for our clients. Communities, just like any other business, property owner, or private party, often find themselves in a situation that requires litigation. At FLS, our combination of experience, knowledge, and zeal makes us ideally suited for this type of dispute.
Community associations are required by law to carry certain insurance. Those policies and their interpretation are often complicated and can lead to disputes, need for interpretation, or even a collections issue. With a background in insurance defense law and coverage disputes, FLS has all the tools to assist communities on these matters. Additionally, legal counsel can help a community board from being taken advantage of or entering into an unfavorable contract with a vendor; FLS regularly reviews and advises on such contracts.
The foundation of the Pyramid of Services is also the foundation of your community association: the collection of assessments. At FLS, we employ a Five-Point Plan specifically designed to maximize recovery and minimize costs, and we tailor that plan to the specific issues facing your community. The Five-Point Plan starts with recording a lien to protect your right to recovery, continues through litigation and settlement efforts, incorporates the exceptional remedies of foreclosure or writ sale, and battles through roadblocks such as bankruptcy, tax sales, lender foreclosure, and even death. We never rest until those funds are in the association's coffers where they belong.
